Jose Montoya was stopped for speeding 15 mph over the limit on Massachusetts Avenue and failing to stop at a stop sign at Massachusetts and S. Broadway. During his initial encounter with Montoya, the officer detected several signs of possible impairment due to alcohol so he administered field sobriety tests. Montoya failed to complete the tests satisfactorily and was arrested for driving under the influence. He was transported to the Indian River County where he refused to take a breath test.
