When there is a lease agreement, there are rules and regulations to abide by within the landlords’ contract. Also, if the rental is within a homeowner’s association the rules and regulations of that community must be followed too. In entering any lease, the applicant(s) is (are) asked the names and number of people who will be living in the rental unit or home. This is to adhere to the restrictions of the landlord and housing regulations set up by the city or county codes for that dwelling. The usual standard is no more than 2 people per bedroom. In general, a 3-bedroom house generally has a rule of thumb for a maximum of 6 people permitted for that dwelling, two per room which would prevent overcrowding or more than one family living in a domicile at once.
One of the first clauses of a lease shows the beginning and ending dates and identifies the parties. The landlord should be certain that any party who is to be responsible for the performance under the lease is named along with all adult parties using the premises. This allows both the landlord and in the case of an association to scrutinize the applicants, their credit, and their backgrounds.
Let’s move on to your responsibility as a renter when, during the terms of your lease, you would like another person or persons to live with you. If a renter does not notify a landlord or association of a new tenant residing in the home or community, that could be used as a cause for eviction by the landlord or association. In most cases, the landlord or association will allow an additional tenant solely with the notification process. However, landlords and associations can insist that any potential new tenant to the lease apply, provide their personal information, and have a background check performed. Again, failure to disclose any new tenants could, and would, be used as grounds for an eviction process if the landlord finds out and deems the new tenant to be unsuitable.
